HostBanshee* provides web hosting to many clients, and we have a responsibility to protect each client and to provide the best services available. The following guidelines were designed to ensure these obligations are met.

CONTENT: All services provided by HostBanshee may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene or material protected by trade secret and other statute, and invasion of privacy. The subscriber agrees to indemnify and hold harmless HostBanshee from any claims resulting from the use of the service which damages the subscriber or any other party.

All pornographic content and sex-related merchandising is prohibited on all HostBanshee servers. This includes sites that may infer sexual content or links to adult content elsewhere. HostBanshee will be the sole arbiter in determining violations of this provision.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to HostBanshee servers or any other server on the Internet. Links to such materials are also prohibited.

Examples of unacceptable content or links:

• Pirated Software
• Hacker programs or archives
• Warez sites where software is contained on the server for puroses of distribution.

HostBanshee will be the sole arbiter as to what constitutes a violation of this provision.

COMMERCIAL ADVERTISING E-MAIL: Spamming, or the sending of unsolicited email, from a HostBanshee server or using an email address or domain that is maintained on a HostBanshee machine as reference is STRICTLY prohibited. HostBanshee will be the sole arbiter as to what constitutes a violation of this provision.

INTELLECTUAL PROPERTY VIOLATIONS: Engaging in any activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities. Also, engaging in activity that violates privacy, publicity, or other personal rights of others. HostBanshee is required by law to remove or block access to customer content upon receipt of a proper notice of copyright infringement. It is also HostBanshee's policy to terminate the privileges of customers who commit repeat violations of copyright laws.

MISUSE OF SYSTEM RESOURCES: Any attempt to undermine or cause harm to a server, or customer, of HostBanshee is strictly prohibited. This includes, but is not limited to:

using programs that consume excessive CPU time; allowing the use of mail services, mail forwarding capabilities, or autoresponders other than for the customer's own account; resale of disk space without an appropriate reseller agreement; use of servers for backup of files unrelated to the web site of the account; or resale or remote access to CGI scripts installed on our servers. Operation of IRC servers or IRC bots on our servers will result in an immediate suspension of service.

Software / Programs not allowed on the server:

We do not allow the use of any CGI chat software, though JAVA chat software is allowed, provided you let the support staff know through the .

No SPAMMING software is allowed to be run. This includes, but is not limited to bulk e-mail software. By running this software you give HostBanshee permission to seize your domain name.

CANCELLATION: Cancellation can be made via the . Although no notice is required, and there is no cancellation fee, all fees paid for service up to the notice of cancellation are non-refundable. If cancellation is made within the first 30 days of service all hosting fees will be refunded. This does not include fees for domain registration.

SUSPENSION: Activity which results in a suspension or deactivation of an account will result in a forfeiture of fees paid. Complaints made regarding abuses of an account will be grounds for suspension.

REFUSAL OF SERVICE: We reserve the right to refuse, cancel, or suspend service at our sole discretion.

Please direct any reports of violations of the above policies to abuse@hostbanshee.com. Failure to follow any term or condition will be grounds for immediate account deactivation.

PAYMENT INFORMATION: You are given an adequate time to make your payments on your account. If you fail to pay by the date listed on the bill (if you're not paying by credit card) then a late fee of 5% can be enforced.

Bad credit card or insufficent funds:

HostBanshee reserves the right to charge you a $5.00 fee for any credit card which is returned for insufficent funds. This fee is imposed at our discretion. We will give you plenty of notice as to when your billing cycle is. It is your responsibility to make sure funds exist. If you expect that there will be insufficent funds in your account, please send us an e-mail.

Checks returned due to insufficient funds or other problems.

If a check is returned due to insufficient funds or other problems, your account will be immediately suspended. There will be a fee of $25.00 for any returned checks. These accounts must be paid in full to include the $25.00 service fee, before the account will be re-activated.

DISCLAIMER: HostBanshee cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by HostBanshee are resold. Thus, certain equipment, routing, software, and programming used by HostBanshee are not directly owned or written by HostBanshee. Moreover, HostBanshee holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account wiithout advanced notice for any reason without restitution as Host Banshee sees fit.

You are responsible for keeping up to date on these terms and conditions. Should they change, the changes will apply toward you. We may or may not notify you of changes to these conditions.
